March 22, 2021

North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Chris Bruns, Jerry Woodruff and County Clerk, Rebecca Rossell.  Weems offered prayer. Weems called the meeting to order at 9:00 A.M.

 

Chairman Weems announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Bruns to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on March 15, 2021.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Bruns, seconded by Woodruff to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

No action was taken on the gWorks contract for re-districting services.  Additional questions will be addressed.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared as well as County Treasurer, Shelli Franzen.

 

Motion by Bruns, seconded by Woodruff to approve the minutes regarding the Lincoln County Board of Equalization meeting held on March 15, 2021. Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

No certificates of correction or refund submitted by the County Assessor.

 

Motion by Hewgley, seconded by Woodruff to approve the motor vehicle tax exemption application submitted by American Red Cross as recommended for approval by the County Treasurer.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:20 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Chairman Weems thanked the team involved in creating the Community Based Juvenile Services Plan for all their hard work.

 

Motion by Hewgley, seconded by Bruns to approve and authorize the Chairman to sign the 2021-2023 Community Based Juvenile Services Aid Request for Application Year 1.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

A public hearing was opened at 9:35 A.M. on File No. AM21-001 an application by Wesley and Kelly Kudera for an amendment to the Lincoln County Comprehensive Development Plan 2013 Future Land Use Map to amend certain lands from Transitional Agricultural to Urban Reserve located at the intersection of East Suburban Road and North Highway 83 on property described

as part of the W ½ NW ¼ of Section15, Township 14 North, Range 30 West of the 6th P.M., North Platte, Lincoln County, Nebraska.

 

Lincoln County Planning Director, Judy Clark, read the review comments from the Planning Commission.

 

Commissioner Bruns asked if there were concerns from the Planning Commission.

 

Clark replied that one member voted no.  The other two members were absent.

 

Commissioner Hewgley questioned if the adjoining land was classified as Transitional Ag.

 

Clark responded yes. She commented that density was the issue.

 

Commissioner Woodruff wondered if this type of amendment had been done before.

 

Clark affirmed that it had.

 

Commissioner Henry asked the applicant if he was the developer.

 

Wesley Kudera replied that he owns the property.  He is going to try to sell the lots first, if they don’t sell then he will develop them.

 

Commissioner Weems noted that the Sandhills Acres Subdivision does have protective covenants.

 

Kudera informed the board that he has a letter from the County Highway Supt. stating she had no concern with the subdivision.

 

Justin Roberts spoke in opposition.  He is not opposed to progress but he does have some concerns.  There are 4 homes in the area already with junk cars and other items.  This area is a different type of land for construction.  He is not opposed to one or maybe two homes but thinks four is too many for this area.  He also questioned who would maintain the road.

 

Jim Neal lives north of the property.  He is concerned about sand blowing on to his property during construction.  He also feels one or maybe two homes would be o.k. but not four.

 

Gary Garrison, also a neighbor to the property is opposed. He reported that at the first meeting of the Planning Commission the applicant did not appear in person.  At that meeting the Planning Chairman suggested to the person representing them that they have covenants drawn up.  At the second meeting of the Planning Commission the applicant appeared and did have covenants but he was not sure they pertained to this project. He knows firsthand how difficult it can be to enforce the covenants.  Information shows that the property was purchased by Mr. Newport and then deeded to Kudera’s . He questioned if the covenants presented were reasonable and if they had been recorded in the Register of Deeds Office.

 

Chairman Weems stated for the record that the County Board accepted Garrison’s White Horse Creek Ranch covenants as a comparison.

 

Commissioner Woodruff noted that the covenants are very specific.

 

Judy Clark, informed the board that the Planning Commission does not enforce covenants.  Covenants are not required and usually are not requested, although in this particular case they did.

 

Kudera stated he is familiar with the area.  He has been building houses for 20 years.  He was willing to bring covenants to the Planning Commission and he does want to maintain integrity in the neighborhood.

 

The public hearing was closed at 10:15 A.M.

 

Chairman Weems reported that he has had calls about the danger of turning off of Highway 83 onto Suburban Road where this subdivision would be located.

 

Kudera told him there are alternative routes but they are not convenient.

 

Commissioner Hewgley commented that he would like to look at this area before he voted in fairness to everyone involved.

 

Commissioner Henry stated there are pros and cons to the application.  He feels strong covenants are necessary and the development of sand can be scary.

 

Commissioner Bruns would like to do more research as well.  Our area is in need of additional housing.

 

Commissioner Woodruff also applauded his efforts for housing but has concerns about the soft ground and what will happen to lots if there are animals allowed.

 

Motion by Hewgley, seconded by Henry to continue this planning item for further research.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

A public hearing was opened at 10:25 A.M. on File No. Z21-001an application by Wesley and Kelly Kudera to rezone certain lands from a TA-1Transitional Agricultural District to an R-2 Urban Density Residential District located at the intersection of East Suburban Road and North Highway 83 on property described as part of the W ½ NW ¼ of Section 15, Township 14 North, Range 30 West of the 6th P.M., North Platte, Lincoln County, Nebraska.

 

County Planning Director, Judy Clark, read the review comments from the Planning Commission concerning the application for rezoning.  She told board members that the amendment previously heard, would need to be approved, before any action can be taken on the rezoning.

 

Commissioner Hewgley wanted to clarify for the records that the vote taken on this matter at the Planning Commission hearing only included those that were present at that meeting.

 

The public hearing was closed at 10:28 A.M.

 

Motion by Hewgley, seconded by Bruns to continue this planning item to a later date.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

The following bids were received on a truck for Region 51 Emergency Management:  Bill Summers Ford – 2021 Ford – $36,952.00; Janssen Chrysler – 2021 Dodge Ram – $30,804.00.

 

Motion by Henry, seconded by Woodruff to accept the low bid of Janssen Chrysler for a 2021 Dodge Ram truck for $30,804.00. Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye’.  Nays, none.

 

Motion by Hewgley, seconded by Bruns to set April 12, 2021 at 10:00 A.M. to receive bids for Lincoln County Courthouse 2nd and 3rd Floor Restroom Remodel Project. Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Henry to approve and authorize the Chairman to sign the special designated liquor application submitted by Old Depot Vineyard & Winery for a wedding reception on April 17, 2021 at Harbor Lights.  Upon roll call vote Hewgley, Weems, Henry, Bruns and Woodruff voted “aye”.  Nays, none.

 

County Assessor, Julie Stenger and County Appraiser, Henry Vogt appeared to inform the County Board of the plan to purchase a used vehicle for the Lincoln County Assessor’s Office.  There is money in her current budget for this purchase and will not require sealed bids per state statute. They will be looking at used four wheel drive vehicles.

The meeting was adjourned at 11:18 A.M.

 

Advance notice and the agenda for the March 22, 2021 board meetings were sent to the county board and all others requesting the same.  Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on March 19, 2021; and was also emailed to the media on March 19, 2021.

 

The agenda for the meetings to be held on Monday, March 29, 2021 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
