February 25, 2019

North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Bill Henry, Kent Weems, Walt Johnson, Jerry Woodruff and County Clerk, Rebecca Rossell.  Johnson offered prayer. Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Johnson to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on February 19, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Weems to place on file the fee report submitted by the County Treasurer. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Weems to approve and authorize the Chairman to sign the Fire Alarm Inspection agreement with Nebraska Safety and Fire Equipment, Inc. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Woodruff to approve the appointment of Mitch Moorhead to the Lincoln County Planning Commission to finish the term of Betty Sones due to resignation which will expire August, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Weems, seconded by Henry to approve the minutes regarding the Lincoln County Board of Equalization meeting held on February 19, 2019. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

Motion by Johnson, seconded by Henry to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”. Nays, none.

 

Motion by Woodruff, seconded by Weems to approve going into closed session at 9:17 A.M. concerning strategy session regarding pending litigations, which is clearly necessary for protection of the public interest and to protect attorney client privilege. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Chairman Hewgley restated the motion for the closed session.

 

Motion by Woodruff, seconded by Weems to approve going into open session at 10:07 A.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Weems, seconded by Henry to approve entering into and authorizing the Chairman to sign a written stipulated agreement with Luke Estates, L.P., regarding Petition filed by Lincoln County Board of Equalization with the Nebraska Tax Equalization & Review Commission challenging the income-approach calculation method under Neb. Rev. Stat. § 77-1333 in regards to Luke Estates, L.P., for the 2019 tax year. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Johnson, seconded by Henry to approve entering into and authorizing the Chairman to sign a written stipulated agreement with Parkland Estates II, L.P., regarding Petition filed by Lincoln County Board of Equalization with the Nebraska Tax Equalization & Review Commission challenging the income-approach calculation method  under Neb. Rev. Stat. § 77-1333 in regards to Parkland Estates II, L.P., for the 2019 tax year. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 10:12 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Henry, seconded by Woodruff to approve application File No. SU19-001 by Terry and Kristine Becher for Becher First Subdivision. The subdivision will reconfigure two existing lots to allow separation of the existing home sites.  The property is located at 10467 W Platte Valley Rd in a TA-1 Agricultural District on property described as part of the S ½ of the SE ¼ of Section 17, Township 14N, Range 31W of the 6th P.M. Lincoln County, Nebraska.  Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

The following bids were received for first floor remodel of Courthouse restrooms: Wayne Dowhower Construction, Inc. – Base Bid – $191,600.00, Alternate #1 – Deduct $11,300; Paulsen, Inc. – Base Bid – $275,000.00, Alternate #1 – Deduct $35,000

 

Motion by Weems, seconded by Henry to approve and accept the Base Bid of Wayne Dowhower Construction, Inc. in the amount of $191,600.00. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Motion by Woodruff, seconded by Johnson to adopt and approve Resolution 2019-06

which incorporates a Drug Free Work Place Policy into the “Lincoln County Employee

Policy Handbook.”   Upon roll call vote Hewgley, Weems, Henry, Johnson and

Woodruff voted “aye”. Nays, none.

 

Presentation by Paul Greiger of D.A. Davidson on possible Highway Allocation Bond issue.

 

Commissioner Henry asked why the bonds are not rated.

 

Grieger replied that some bonds don’t need rating and they do analysis each time. He also commented that he feels the shorter bond term would be better for the county and fiscally responsible.

 

Commissioner Weems questioned the possibility of splitting it up into 2 or 3 smaller bonds to allow more diversified investors.

 

Andy of D. A. Davidson replied that the minimum bond amount to purchase would be $5000 which allows diversified investors.

 

Commissioner Weems wants to make sure the projects are prioritized and that we have enough funding to complete the priorities.

 

Highway Supt. O’Dell reported that with armor coat on the subdivision roads will last between 10 to 15 years and county roads would be overlayed on the priority list. The first estimate for the priority list projects was 3.1 million dollars.  However market changes may add another 20% to the asphalt price.

 

County Board took no action on the proposed bond issue. County Board will work with County Highway Supt. to prioritize and revise, if needed, the projects that would be done with bond proceeds.

Motion by Johnson, seconded by Woodruff to adjourn the meeting at 12:20 P.M. Upon roll call vote Hewgley, Weems, Henry, Johnson and Woodruff voted “aye”.  Nays, none.

 

Advance notice and the agenda for the February 25, 2019 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on February 21, 2019; and was also emailed to the media on February 21, 2019.

 

 

The agenda for the meetings to be held on Monday, March 4, 2019 will be kept

continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
