March 26, 2018

North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Deterding called the meeting to order at 9:00 A.M.

 

Chairman Deterding announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on March 19, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Hewgley to approve and authorize the Chairman to sign various polling place rental agreements for the 2018 Elections. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:18 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Hewgley, seconded by Henry to approve the minutes regarding the Lincoln County Board of Equalization meeting held on March 19, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”. Nays, none.

 

Motion by Henry, seconded by Hewgley to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor on personal property. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:19 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Henry, seconded by Hewgley to approve File No. SU18-004 an application by Thomas and Deanna Curtis and Brad Betts for Betts 2nd Administrative Subdivision.  The property is located at 3657 North Trinity Road in a TA-1 Transitional Agricultural District and is described as part of the SW ¼ of Section 23, Township 14 North, Range 32 West of the 6th P.M., Lincoln County, Nebraska.  Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

The following informal bids were received for a walk thru scanner (metal detector) for the Lincoln County Courthouse security: Protective Technologies International – $3726.03 and Smiths Detection – $4610.00.

 

Motion by Henry, seconded by Hewgley to approve the purchase of a Garrett walk thru scanner (metal detector) from Protective Technologies International for the Lincoln County Courthouse in the amount of $3726.03. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Nancy Striebel, Executive Director of the Lincoln County Community Development Corporation explained the project for the Rural Work Force Housing Grant.

 

The public hearing on the Rural Work Force Housing Grant was opened at 10:07 A.M.

 

Bernice Zeigler stated she felt it was a good project and that no county tax dollars were involved.

 

Brent Roggow commented that he also felt it was a great project as housing is a big issue in North Platte.

 

The public hearing was closed at 10:09 A.M.

 

Motion by Hewgley, seconded by Henry to approve and authorize the Chairman to sign the special designated liquor permit submitted by Aden Enterprises for a fundraiser at Lincoln County Fairgrounds on May 27, 2018. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to set April 23, 2018 at 9:45 A.M. to open sealed bids for the purchase, conversion, installation and maintenance of an Assessment Administration and Computer Assisted Mass Appraisal (CAMA) software for the Lincoln County Assessor’s Office, and designate the Lincoln County Clerk, Becky Rossell, to publish public notice, soliciting sealed bids, as required by law. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

Motion by Henry, seconded by Hewgley to go into closed session at 10:25 A.M. concerning strategy session regarding imminent litigation and to protect attorney client privilege, which is clearly necessary to protect the public interest. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Chairman Deterding restated the motion for the closed session.

 

Motion by Henry, seconded by Hewgley to go into open session at 10:45 A.M. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Henry to approve entering into an agreement for professional legal services with The Ochs Law Firm regarding litigation matters, pursue all civil remedies regarding opioid epidemic and authorize the Chairman to sign. Upon roll call vote Hewgley, Henry and Deterding voted “aye”.  Nays, none.

 

Approved the following claims as presented for payment:

 

The meeting was adjourned at 11:03 A.M.

 

Advance notice and the agenda for the March 26, 2018 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on March 23, 2018; and was also emailed to the media on March 23, 2018.

 

The agenda for the meetings to be held on Monday, April 2, 2018 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
