January 17, 2017

North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Henry offered prayer. Chairman Henry called the meeting to order at 9:00 A.M.

 

Chairman Henry announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on January 9, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley seconded by Deterding to approve and adopt Resolution No. 2017-02 for substitution of securities by Equitable Bank as pledged to the Lincoln County Treasurer. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Deterding, seconded by Hewgley to approve the minutes regarding the Lincoln County Board of Equalization meeting held on January 9, 2017. Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and authorize the Chairman to sign the certificates of correction or refund submitted by the County Assessor. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:22 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Deterding, seconded by Hewgley to approve declaring the county’s scrap iron in the Lincoln County Department of Roads to be surplus property, which is obsolete or unusable by the County. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to place the value on the surplus property (scrap iron) at $80 per ton and authorize Lincoln County Highway Superintendent, Carla O’Dell, to sell the surplus property (scrap iron) to Alter Metal Recycling, contingent on the total value of the surplus property (scrap iron) being under $2500. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the following appointment and set the 2017 salary for the following department:

 

Veterans Service Officer                Paul Cooper                         $41,725/ $22.93 per hour

 

Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the following appointment and set the 2017 salary for the following department:

 

Noxious Weed Supt.                       Todd Herndon                      $31,130/$18.33 per hour

 

Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the following appointment and set the 2017 salary for the following department:

 

Emergency Management               Brandon Myers                     $48,256/$23.20 per hour

 

Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve the following appointment and set the 2017 salary for the following department:

 

Highway Supt.                                  Carla O’Dell                          $53,160/$25.56 per hour

 

Upon roll call vote Deterding, Hewgley and Henry voted “aye”. Nays, none.

 

Motion by Hewgley, seconded by Deterding to approve and adopt Resolution No. 2017-03 to repeal and set aside the “Lincoln County Employee Policy Handbook” adopted December 22, 2008, which went into effect on January 1, 2009, plus all amendments, and replace it and all amendments to it with a new “Lincoln County Employee Policy Handbook.” Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to give authority to Craig Dirrim, attorney at law, to proceed with legal action, including filing a suit on behalf of The county of Lincoln, Nebraska, (commonly referred to as Lincoln County), against NEBCON, Inc., a Nebraska Corporation, (“NEBCON”), regarding NEBCON’s failure to meet the requirements of the contract with Lincoln County, Courthouse HVAC Replacement Phase I Production Well Project. Upon roll call vote Deterding, Hewgley and Henry voted “aye”.  Nays, none.

 

The 10:15 A.M. agenda item for the special designated liquor permit for Suzie’s Pizza (Keane Lohmiller) was postponed at their request.

 

Approved the following claims as presented for payment:

 

The meeting was adjourned at 10:16 A.M.

 

Advance notice and the agenda for the January 17, 2017 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on January 13, 2017; and was also emailed to the media on January 13, 2017.

 

The agenda for the meetings to be held on Monday, January 23, 2017 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
