Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell.  Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

 

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on June 20 & June 23, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-21 to write off uncollectible funds for the Lincoln County Noxious Weed Department in the amount of $8,753.00 from 2013-2014. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to place on file the fee report submitted by the County Sheriff. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and authorize the Chairman to sign a lease agreement with NMC for a skid steer for the Lincoln County Department of Roads. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign entering The county of Lincoln into a three (3) year lease agreement with Gordon Petersen and Mary Petersen, whereby the County will lease an office (Suite 203) in a commercial building located at 102 East 3rd Street in the city of North Platte, Lincoln County, Nebraska, from Gordon Petersen and Mary Petersen.  Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-22 for addition of securities by NebraskaLand National Bank as pledged to the County Clerk. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-23 to authorizing the Chairman to sign an Interlocal Agreement with Kimball County to house inmates at the Lincoln County Detention Center. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-24 authorizing the Chairman to sign an Interlocal Agreement with Thomas County to house inmates at the Lincoln County Detention Center. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-25 authorizing the Chairman to sign an Interlocal Agreement with Keith County to house inmates at the Lincoln County Detention Center. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-26 authorizing the Chairman to sign an Interlocal Agreement with Logan County to house inmates at the Lincoln County Detention Center. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign a subscription contract with GIS Workshop for the Lincoln County Emergency Management Office. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-27 authorizing a transfer of $3900 from the General Misc. Budget to the General Fund (O.A.S.I.) budget. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-28 authorizing a transfer of $150 from the General Misc. Budget to the General Public Defender Budget. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:20 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

 

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on June 20 & June 23, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

 

Motion by Deterding, seconded by Henry to approve and authorize the chairman to sign the certificates of correction and refund as submitted by the County Assessor on real property. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve notice of valuation changes numbered 2016-79 thru 2016-82 as submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Discussion was held concerning the special valuation protests filed with the County Clerk.

 

Protest # – 2016-1SV – Jerome Vieyra.   He reports that this parcel has been agricultural since 1958.  There has been corn, oats, cattle and goats on the land at various times.  He feels that it meets the criteria to be considered for special valuation.

 

County Assessor, Julie Stenger, stated the methodology that was used beginning in 2012 in establishing valuation on this type of property has been changed for 2016. She worked with the state liaison and looked at other counties to try and equalize the value.  If there was 50% or more accretion land and if there was minimal agricultural use it was

denied.

 

Commissioner Hewgley asked if there was state statute concerning this matter.

 

Stenger replied that state statute does not go into detail.

 

Commissioner Henry questioned why he was requesting such a decrease in the value.

 

Mr. Vieyra responded because of the flooding in recent years.

 

Protest # – 2016-2SV – Jerome Vieyra. This property adjoins the other parcel being protested.  He reports that this is just wasteland.

 

Stenger read the definition of recreational use as it does not mean for just hunting and fishing.

 

Protest #-2016-3SV – Francis C. Peck, Sr.   He commented that his parcel is in the area by the diversion dam and he has never done anything with it.  Per his contract he cannot sell the land and when the contract is finished it will be donated to the Opportunity Center.  It has been flooded also in recent years.

 

Protest # 2016- 4SV – Bonnie & Bob Smith. The property has been flooded the last five years.  Central raised a dike on the south side of Fremont Slough and a lot of the time this is just wasteland.  They would like to see it zoned agricultural.

 

Protest # 2016-5SV – Donald Goddard. This property does have cattle on it 80% of the time.  He reported that he has received income from this property for the last 17 years.  He feels the property should stay agricultural.

 

Stenger commented that they had looked at changing this parcel to a rural residential which would lower the valuation.

 

Motion by Deterding, seconded by Henry to continue special valuation protests numbered 2016-1SV thru 2016-5SV to the July 5, 2016 Lincoln County Board of Commissioners meeting. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 10:30 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Deterding, seconded by Henry to approve and authorize the Chairman to sign the grant application to be submitted to the Nebraska Office of Highway Safety by the Lincoln County Sheriff’s Office in the amount of $7,980.00 for an overtime operation July 20 – August 7, 2016. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Henry to approve and adopt Resolution No. 2016-29 to consummate a transaction whereby real estate (legally described as The West 54’ of Lot 161, Original Town of North Platte, Lincoln County, Nebraska) is acquired by The county of Lincoln for the purchase price of $72,500 from Leroy W. Wood. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

 

Motion by Henry, seconded by Deterding to approve and adopt Resolution No. 2016-30 which adopts Amendment to Article 11 of the Zoning Regulations of The county of Lincoln, Nebraska. Upon roll call vote Deterding, Henry and Hewgley voted “aye”.  Nays, none.

The Lincoln County Board of Commissioners recessed at 11:56 A.M. and reconvened at 12:53 P.M.

 

The Lincoln County Board of Commissioners recessed at 12:54P.M. and reconvened as the Lincoln County Board of Equalization.

 

The Lincoln County Board of Equalization discussed and considered Property Valuation Protests (Form 422).

 

The Lincoln County Board of Equalization recessed at 4:10 P.M. and the Lincoln County Board of Commissioners reconvened.

Advance notice and the agenda for the June 27, 2016 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on June 24, 2016; and was also emailed to the media on June 24, 2016.

 

The agenda for the meetings to be held on July 5, 2016 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
