North Platte, Nebraska

Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Duane Deterding, Bill Henry, Joe Hewgley and County Clerk, Rebecca Rossell. Deterding offered prayer. Chairman Hewgley called the meeting to order at 9:00 A.M.

Chairman Hewgley announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on July 13, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.    

Motion by Deterding, seconded by Henry to receive and order filed the treasurer’s receipts. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to approve and authorize the chairman to sign the Annual Subgrant Agreement for Child Support Enforcement between Nebraska Department of Health & Human Services and Clerk of District Court correcting the typo from Antelope County to Lincoln County. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to place on file the fee report submitted by the County Treasurer. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding, to place on file the Condition of the Treasury of Lincoln County, NE from January 1, 2015 to June 30, 2015. Upon roll call vote Henry, Hewgley and Deterding voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the special designated liquor permits submitted by Sculleys LLC for receptions to be held on the following dates and locations: August 8, 2015 – CB’s Hideaway

                                                                            August 15, 2015 – CB’s Hideaway

                                                                             August 15, 2015 – Lincoln Co. Fairgrounds

                                                                             August 22, 2015 – Harbor Lights

Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

County Assessor, Julie Stenger appeared.

Motion by Henry, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on July 13, 2015. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

No certificates of correction or refund submitted by the County Assessor.

Motion by Deterding, seconded by Henry to accept the letter of explanation for the late filing of the 2015 Homestead Exemption application by Robert & Karen Allen. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to accept the letter of explanation for the late filing of the 2015 Homestead Exemption application by Kendlyn & Kimberly Herrick. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to accept the letter of explanation for the late filing of the 2015 Homestead Exemption application by Wallace Rodine. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Henry, seconded by Deterding to accept the letter of explanation for the late filing of the 2015 Homestead Exemption application by Russell & Sharon Estill. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to accept the letter of explanation for the late filing of the 2015 Homestead Exemption application by Dixie Anderson. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

Motion by Deterding, seconded by Henry to approve the notice of valuation changes numbered 2015-109 thru 2015-111 as submitted by the County Assessor. Upon roll call vote Deterding, Henry and Hewgley voted “aye”. Nays, none.

The Lincoln County Board of Equalization recessed at 9:26 A.M. and the Lincoln County Board of Commissioners reconvened.        

The Public Hearing was opened at 9:32 A.M. on a proposed Amendment to the “Zoning Regulations of The county of Lincoln, Nebraska,” recommended by the Lincoln Planning Commission, in which the proposed Amendment amends Article 11 of the “Zoning Regulations of The county of Lincoln, Nebraska,” and is entitled “PROPOSAL AMENDING ARTICLE 11: Amendments.” The proposed changes are only in regards to the Amendments Article (“Article 11: Amendments”) of the “Zoning Regulations of The county of Lincoln, Nebraska.”

Lincoln County Planning Director, Judy Clark, and Deputy County Attorney, Joe Wright, gave brief summaries explaining the reason the clarification was needed in the regulations.

Bernice Zeigler commented this proposal was difficult to understand and that there should be a simple way to make changes so the public would understand and know where to get copies of the information.

Willis Jepsen requested that they leave in Section G which they were planning to strike as part of the amendment. This section tells they public what happens after an amendment is adopted and will be consistent.

Judy Clark replied that Section G is per state statute so they felt it was redundant and should be stricken.

The public hearing was closed at 10:03 A.M.

Terry Meier of JEO Consulting appeared by phone to discuss a proposed grant application to the Nebraska Game & Parks Commission on recreational trails at Lake Maloney. Lincoln County has been requested to be the Project Sponsor.   The Lake Maloney Property Owner’s Association would be responsible for any match and the maintenance of the proposed trail. Brian Hope of Nebraska Public Power District reported that they would be willing to lease the proposed area for the trail to the county for 25 years with a renewal clause.

Chad Marsh of Kirkham Michael & Associates, Inc. appeared to give board members a brief preview of what their company does for counties when a large project must “haul” items to the site and the damage that can be to done to the county road system during this process. A future project will be using approximately 50 miles of “haul roads” in Lincoln County.

Emergency Management Director, Brandon Myers, gave his quarterly report for the period ending June 30, 2015.

Recessed as the Lincoln County Board of Commissioners at 12:39 P.M. and reconvened as the Lincoln County Board of Equalization.

Discussed and considered Property Valuation Protests (Forms 422’s).

The Lincoln County Board of Equalization recessed at 5:11 P.M. and the Lincoln County Board of Commissioners reconvened.

The meeting was adjourned at 5:12 P.M.

The Lincoln County Board of Equalization will meet at 9:00 A.M. on July 21, July 22, July 23 and July 24 as needed in the Commissioners Room to discuss and consider property valuation protests (Form 422’s).

Advance notice and the agenda for the July 20, 2015 board meetings were sent to the county board and all others requesting the same. Advance public notice (includes agenda) of the Lincoln County Board of Commissioners meeting and the Lincoln County Board of Equalization meeting was posted at the Lincoln County Courthouse, City Hall and the Lincoln County website on July17, 2015; and was also emailed to the media on July 17, 2015.

The agenda for the meetings to be held on July 27, 2015 will be kept continually current and open for inspection at the office of the Lincoln County Clerk. The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M. The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
