August 20, 2012

North Platte, Nebraska

 

Meeting of the Lincoln County Board of Commissioners. Present were Commissioners Joe Hewgley, Duane Deterding, Willis Roethemeyer, and Deputy County Clerk, Terry Heessel.  Deterding offered prayer.  Chairman Roethemeyer called the meeting to order at 9:00 A.M.

 

Chairman Roethemeyer announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Commissioners meeting held on August 13, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to receive and order filed the treasurer’s receipts.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Commissioners recessed at 9:15 A.M. and the Lincoln County Board of Equalization convened.

 

Chairman Roethemeyer announced the Open Meeting Act with amendments is posted for public review and the county board will comply with the open meeting requirements.

 

County Assessor, Julie Stenger appeared.

 

Motion by Hewgley, seconded by Deterding to approve the minutes regarding the Lincoln County Board of Equalization meeting held on August 13, 2012.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Deterding, seconded by Hewgley to approve the certificates of correction or refund submitted by the County Assessor.   Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

The Lincoln County Board of Equalization adjourned at 9:18 A.M. and the Lincoln County Board of Commissioners reconvened.

 

Motion by Hewgley, seconded by Deterding to join the public hearings concerning the following File No. AM12-001 thru File No. AM12-003.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

1.       a.  Public Hearing File No. AM12-001 discuss and consider passing a Resolution adopting the Lincoln County, Nebraska Comprehensive Development Plan Update 2011-2030.

b.  After the public hearing on File No. AM12-001 consider action on Resolution No. 12-21, concerning adoption of LINCOLN COUNTY, NEBRASKA COMPREHENSIVE DEVELOPMENT PLAN UPDATE 2011 TO 2030.

2.       a.  Public Hearing  File No. AM12-002 discuss and consider passing a Resolution adopting Zoning Regulations for The county of Lincoln, Nebraska.

b.  After the public hearing on File No. AM12-002 consider action on Resolution No. 12-22, concerning adoption of the Zoning Regulations of The county of Lincoln, Nebraska.

3.       a.  Public Hearing  File No. AM12-003 discuss and consider passing a Resolution adopting Subdivision Regulations for The county of Lincoln, Nebraska.

b.  After the public hearing on File No. AM12-003 consider action on Resolution No. 12-23, concerning  adoption of The Subdivision Regulations of the county of Lincoln, Nebraska.

The public hearing was opened at 9:30 A.M.

 

Lincoln County Planning Director, Judy Clark, and consultant, Keith Marvin, explained why the update to the comprehensive plan was needed.

 

Bernice Zeigler commented on the zoning regulations that pertain to her property.  Her property area is going to be considered industrial which concerns her peaceful use of her property.

 

Marvin suggested making the stone crushing to a conditional use.  He commented that anything that is prohibited will need to be a conditional permit.

 

Mrs. Zeigler would like the area to stay light industrial as it is currently zoned.

 

Travis Anderson didn’t feel that enough notice was given to the property owners.  He talked about the road to Hwy 83 used by Perrett Construction.

 

Roger Robinson stated that E Hansen Trail Road is not able to be maintained because of the light industrial use it already has.

 

Donna Obermier also objected to changing this area to industrial and is concerned about the concrete dust hazard for people and livestock.

 

Scott Warner objected to the crushing of concrete in this area.

 

Eric Seacrest commented that the original plan was adopted in 1986 with amendments through the years.  This comp plan has been carefully processed but is not perfect yet.

 

Judy Clark, Planning Director, stated these are working documents and can be amended.

 

Keith Marvin, Consultant, suggested an option to change the purple area to transitional ag and move (h) to conditional use.  The typos and table of contents will be corrected.

 

No other comments were received.

 

The public hearing was closed at 10:40 A.M.

 

Motion by Hewgley, seconded by Deterding to continue discussion on this matter of File No. AM12-001 thru File No. AM12-003 until a later date.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Motion by Hewgley, seconded by Deterding to go into closed session at 10:42 A.M. concerning strategy regarding litigation and to protect attorney-client privilege, which is clearly necessary to protect the public interest.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

Chairman Roethemeyer restated the reason for the closed session.

 

Motion by Hewgley, seconded by Deterding to go back into open session at 11:08 A.M.  Upon roll call vote Hewgley, Deterding and Roethemeyer voted “aye”.  Nays, none.

 

No action was taken following the closed session.

 

A budget work session was held.

 

Approved the following claims as presented for payment:

 

The meeting was adjourned at 12:30 P.M.

 

Advance notice and the agenda for the August 20, 2012 board meetings were sent to members of the County Board, County Attorney and all others requesting the same.  Notice was posted at the Lincoln County Courthouse, City Hall and on the county website.

 

The agenda for the meetings to be held on Monday, August 27, 2012 will be kept continually current and open for inspection at the office of the Lincoln County Clerk.  The regular meeting of the Lincoln County Board of Commissioners will be at the Lincoln County Courthouse in the Commissioners Room at 9:00 A.M.  The regular meeting of the Lincoln County Board of Equalization will be at the Lincoln County Courthouse in the Commissioners Room at 9:15 A.M.
